1. Acceptance of Terms

By accessing or using Model Spawner ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Model Spawner provides AI-powered 3D model generation from images and text prompts. Users can generate 3D models, download them in multiple formats (GLB, OBJ, STL, USDZ), order physical 3D prints, and buy or sell models on the Marketplace. The Service operates on a credit-based system.

3. Accounts

You are responsible for maintaining the security of your account credentials. You must provide accurate information when creating an account. Email verification is required for certain features, including selling on the Marketplace. We reserve the right to suspend or terminate accounts that violate these terms.

4. Credits and Payments

Credits are required to generate 3D models. New users receive free credits upon signup. Additional credits may be purchased. All credit purchases are final and non-refundable. Credits do not expire. If a 3D generation fails due to a system error, credits are automatically refunded.

5. 3D Model Generation — Best-Effort Service

The Service uses third-party AI models to generate 3D content. AI-powered 3D generation is an emerging technology, and results are provided on a best-effort basis. Generated models may contain imperfections including but not limited to mesh artifacts, texture issues, incorrect geometry, or results that do not precisely match the input image. We automatically retry failed generations and may fall back to alternative AI models, but we do not guarantee that any generation will meet specific quality standards or be suitable for any particular purpose. By using the Service, you acknowledge and accept that results will not be perfect.

6. Marketplace

The Marketplace allows users to buy and sell 3D models. To sell on the Marketplace, you must have a verified email address and enable seller status in your profile.

Sellers set their own prices and are responsible for the quality and accuracy of their listings. Seller payouts are processed via Stripe Connect or PayPal depending on your account setup.
Buyers receive a license to use purchased models for personal and commercial purposes, unless otherwise specified by the seller.
We reserve the right to remove listings that violate these terms or our content policies.

7. 3D Print Orders — Best-Effort Quality

Print orders are custom-manufactured products produced from AI-generated 3D models. 3D printing is a physical manufacturing process subject to inherent variability, and the quality of a print depends on the quality of the underlying generated model. By placing a print order, you acknowledge that printed results are provided on a best-effort basis and may contain imperfections including but not limited to surface artifacts, minor dimensional variations, layer lines, and differences from the on-screen preview. Once a print enters the printing stage, it cannot be canceled. Shipping times vary. We are not responsible for delays caused by carriers. See our About page for our full refund and return policies.

8. Acceptable Use

You agree not to use the Service to:

Generate content that is illegal, harmful, or infringes on others' rights
Upload images you do not have the right to use
Attempt to reverse-engineer or exploit the Service
Use automated systems to access the Service without permission
List fraudulent, misleading, or stolen content on the Marketplace

9. Intellectual Property

You retain ownership of images you upload. You own the 3D models generated from your inputs and may use them for personal or commercial purposes, including selling them on the Marketplace. We retain all rights to the Service itself, including its software, design, and branding.

10. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. Both AI-powered 3D model generation and physical 3D printing involve emerging and inherently imperfect technologies. We make no guarantees regarding the accuracy, quality, completeness, or fitness for any particular purpose of any generated model or printed product. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you have paid us in the preceding 12 months.

11. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms.
